1. About these terms
These terms apply to the CyberHire Referral Programme (the "Programme"), run by CyberHire Ltd, a company registered in England and Wales (company number 17389369), of 66 Paul Street, London EC2A 4NA ("CyberHire", "we", "us"). By joining the Programme you ("you", the "Referrer") agree to them.
2. How the Programme works
You introduce us to organisations that may want to use CyberHire. If an organisation you introduce becomes a client on the conditions below, we pay you a referral fee.
3. Registering an introduction
- To be credited, an introduction must be registered with us, through the form at cyber-hire.com/referrals or by email, naming the organisation (and, where you can, the person you are introducing).
- An introduction is credited to the first Referrer to register it. The date we receive the registration starts the credit window.
- We will confirm whether each introduction is accepted. We do not accept an introduction to an organisation that is already a CyberHire client, or that we are already in active conversation with at the time you register it.
4. When the referral fee is earned
The referral fee is earned when all of the following are true:
- the organisation you introduced signs an order with CyberHire within 12 months of the date your introduction was registered (the "credit window"); and
- we have received that organisation's payment for the order.
One referral fee is payable per new client organisation, however many orders it later places. Whether to take on any organisation as a client is entirely our decision.
5. The referral fee
- The referral fee is £500 per new client organisation.
- It is paid in pounds sterling or, at your request, the equivalent in your local currency at the exchange rate on the date of payment. Bank or transfer charges for non-GBP payments may be deducted.
- We pay by bank transfer, normally within 30 days of receiving the client's payment. You must give us valid payment details.
- If the client's payment is refunded or reversed, no fee is due for that client, and any fee already paid for it may be recovered.
6. Tax
The referral fee is paid gross. You are responsible for declaring it and paying any tax, duty or social security contributions due on it where you live. If you are registered for VAT or a similar tax, contact us before you are paid so that the correct invoice can be raised.
7. Your responsibilities
- Only introduce people who are happy to be introduced, and only share someone's contact details with us if you have their permission to do so.
- Describe CyberHire accurately. Do not make promises or commitments on our behalf, including about price, features or results.
- Do not offer or pass on any part of the referral fee, or any other payment or benefit, to anyone at the organisation you introduce.
- By accepting a referral fee you confirm that receiving it does not breach any obligation you owe to anyone else, such as your employer or a client. If you are unsure, tell the relevant party about the fee before you make the introduction.
- Comply with all applicable laws, including anti-bribery and anti-corruption laws such as the UK Bribery Act 2010.
8. Relationship between us
You are not our employee, agent or representative, and you have no authority to bind CyberHire. Nothing in these terms creates a partnership or joint venture in the legal sense. You may say you are part of the CyberHire Referral Programme when making an introduction, but you may not use our name or logo in any other way without our written permission.
9. Your information
We use the details you give us to run the Programme: to register and track your introductions, to contact you and to pay you. See our Privacy Policy for how we handle personal data.
10. Changes and ending the Programme
- We may change these terms or end the Programme at any time by updating this page. Introductions registered before a change keep the terms that applied when they were registered, for their full credit window.
- We may remove a Referrer from the Programme, and withhold fees not yet paid, if they breach these terms.
11. Law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from them.
